NPH Lawyers defeat Criminal A&B Complaint vs. Ayer Officer
After a lengthy court battle, NPH attorneys Gary Nolan and Peter Perroni successfully defended an Ayer, MA Superior Officer against an application for a criminal complaint for assault and battery and filing false police reports. The officer assisted in the arrest of an uncooperative suspect. The suspect was later convicted of resisting arrest. The suspect, however, filed an application for a criminal complaint against our client, an NEPBA member, as well as complaints against other non-NEPBA officers. After a full hearing before a clerk Magistrate, Attorney Nolan was able to defeat the application for a criminal complaint. The matter, however, continued when the suspect appealed the case to a District Court Judge. After two more full days of testimony, Attorneys Nolan and Perroni were able to again defeat the request for criminal process against the NEPBA member. Obviously, due to the significant impact a felony complaint can have both personally and professionally on an officer, it is extremely important to vigorously defend against such allegations from day one - before a complaint issues.
